The Highlights Library, including the servers upon which all content of the Highlights Library is stored, is provided by Highlights for Children International, Inc. on servers hosted and maintained by Chungchydotcom Co., Ltd. Your access to and use of the Highlights Library is subject to the following terms and conditions. In addition, your access to the Highlights Library, whether online or through a mobile application, is facilitated by a third party access provider ("Access Host") and subject to their additional terms and conditions and privacy policies.

Acceptance of Terms and Conditions.

By accessing the Highlights Library, you accept and agree to all of the following terms and conditions (the "Terms and Conditions"). If you do not agree to the Terms and Conditions, you must refrain from accessing or using the Highlights Library.

Revision of Terms and Conditions.

We reserve the right to modify these Terms and Conditions at any time. While we may provide notices of changes to the Terms and Conditions within the Highlights Library or through our Access Hosts, you are responsible for periodically reviewing the Terms and Conditions. Continued access to the Highlights Library after any revision to the Terms and Conditions shall be deemed acceptance of those changes. If you do not agree with any of the revisions, please refrain from accessing or using the Highlights Library.

Fees for Use.

All fees for accessing and using the Highlights Library are charged and collected by our Access Hosts. We do not have access to any credit card or other billing information you provided to those Access Hosts. You agree to settle all disputes over usage fees directly with those third party Access Hosts.

Availability and Monitoring.

While we intend to make the Highlights Library available twenty four hours a day, seven days a week, we reserve the right to control or change: accessibility, hours of use, and availability of features in the Highlights Library. In our efforts to provide a quality experience in the Highlights Library, we may monitor use of the library and its features. We reserve the right to restrict access to any or all portions of the Highlights Library or remove or modify any features or content from the library at any time. Due to the nature of the internet and servers, we cannot be held liable for any disruption in the availability of the Highlights Library. You are solely responsible for providing the equipment used to access the Highlights Library as well as securing your own internet connection/mobile services through which you make access.

Prohibited Uses and Conduct

When accessing or using the Highlights Library, you expressly agree to not:

●  remove, alter, cover, or distort any copyright, trademark, or other proprietary rights notice in Highlights Library;
●  circumvent, disable or otherwise interfere with security-related features of Highlights Library including, without limitation, any features that prevent or restrict access to, or use of, any content or information on the servers housing the Highlights Library;
●  use an automatic device (such as a robot or spider) or manual process to copy or "scrape" Highlights Library content for any purpose without our express written permission;
●  attempt to collect or harvest any personally identifiable information from the Highlights Library including, without limitation, user names, passwords, email addresses, or customer information provided by other users;
●  attempt to or interfere with the proper working of Highlights Library or impair, overburden, or disable the same;
●  decompile, reverse engineer, or disassemble any portion of the Highlights Library;
●  impersonate another user, person, or entity (e.g., using another person’s account information without permission); or
●  engage in any conduct that restricts or inhibits any other user from using or enjoying the Highlights Library.

We reserve the right to deny or terminate the access to, or use of, the Highlights Library by any user who violates these Terms and Conditions. We further reserve the right to pursue any civil and criminal claims we may have against any user who violates these Terms and Conditions or who otherwise accesses the Highlights Library in an unauthorized manner.

User Registration

In order to access or use Highlights Library, you must become a registered user through one of our Access Hosts. You agree to provide such Access Host with true, accurate and complete registration information and, if such information changes, you will promptly update the relevant registration information. During registration, you may be asked by our Access Host to create a user name and password ("Account Information"). You are responsible for safeguarding and maintaining the confidentiality of your Account Information. You are solely responsible for the activity that occurs through the use of your Account Information, whether or not you have authorized the activity. You agree to notify your Access Host immediately of any breach of security or unauthorized use of your Account Information.

Privacy Policy

Highlights and ChungChyDotCom utilize any personally identifiable information we collect for the sole purpose of individualizing the user experience within the Highlights Library. In addition, from time to time, we receive from our Access Hosts information on users relating to technical issues. In such instances, we utilize the information and/or contact the user for the sole purpose of resolving the technical issue. ●  Information you provide to us

Certain features of the Highlights Library individualize the experience, requiring the collection, use, or tracking of certain information (e.g. individual reading preferences, progress tracking, names, device identifier, IP address and/or country of residence, grade levels, reading levels and e-mail addresses). If you use Speaking activities within Highlights Library, we will ask for permission to access your computer or device’s microphone. Once you complete an activity, the voice recording will be stored accessible by teacher(s) and administrators associated with your account for a time period of 4 months. The Services do not allow users (including children) to disclose personal information publicly.

●  Information we collect automatically

We automatically collect certain non-personal information when you use our Services. For example, we may collect device information, such as your device type, operating system type, and/or browser type. We may also collect usage data, such as, what pages and content you accessed, and features you used on our Services. We may combine this device and usage information with other personal information.

●  Cookies and Tracking

Our Mobile App(s) use a variety of technical methods for collecting and tracking device information and usage data, including cookies, pixels, and device IDs. Cookies and pixels are small pieces of text that may be saved on your device when you view our Mobile App(s). Intellectual Property

We own all intellectual property rights in and to the content in the Highlights Library, including copyright and trademark rights. As an authorized user, we grant to you a limited license to copy the content, solely for the purposes of caching, displaying the content on your viewing device and printing the content (if such functionality is activated) in the Highlights Library, solely for your own, personal, non-commercial use. Beyond this very limited license, the Highlights Library content may not be copied, reproduced, modified, published, uploaded, posted, transmitted, "framed" on another site, or distributed in any way, shape or form without our prior written consent.

Disclaimer and Limitation of Liability.

We make every effort to ensure the availability and security of the Highlights Library. Even so, no warranty is expressed or implied by any statement made in these Terms and Conditions and we make no guarantee or warranty, express or implied, as to the availability, reliability, accuracy, or completeness of any content in the Highlights Library and we assume no responsibility for any errors or omissions therein. YOU ACCESS THE HIGHLIGHTS LIBRARY AT YOUR OWN RISK. THE HIGHLIGHTS LIBRARY IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND AND ANY AND ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT ARE SPECIFICALLY DISCLAIMED. NEITHER OF HIGHLIGHTS FOR CHILDREN OR CHUNGCHYDOTCOM, NOR ANY OF THEIR AFFILIATES, EMPLOYEES, AGENTS OR THIRD PARTY CONTENT PROVIDERS SHALL BE LIABLE FOR ANY LOSS RESULTING FROM USE OR UNAVAILABILITY OF INFORMATION OR CONTENT IN THE HIGHLIGHTS LIBRARY, INCLUDING BUT NOT LIMITED TO ANY LOST PROFITS, LOSS OR DAMAGE TO DATA, LOSS OR DAMAGE TO EQUIPMENT USED TO ACCESS THE HIGHLIGHTS LIBRARY, OR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, COMPENSATORY OR INCIDENTAL DAMAGES, EVEN IF THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. If you misuse or abuse the Highlights Library or the content in it, you agree to indemnify us and hold us harmless from any and all claims, liabilities, demands, causes of action, damages, losses, and expenses, including, without limitation, reasonable attorneys' fees and costs of suit, arising out of or in connection with such misuse or abuse.

Miscellaneous

These Terms and Conditions constitute the entire agreement between you and us regarding your use and access to the Highlights Library. As noted, additional terms and conditions and privacy policies may be utilized by our Access Hosts. You are solely responsible for reviewing any such additional terms and policies. If any portion of these Terms and Conditions is found to be unenforceable for any reason, such portion will be deemed severed and will not affect the enforceability of the remaining terms.
